Jury weighs first US foreign bribe sting case (AP)

WASHINGTON ? Jurors have seen grenade launchers, M4 rifles and secretly recorded videos of military suppliers working on a deal to funnel money to an official of an African nation they wanted to buy their weapons.

Now, after a six-week trial, the 12 jurors in federal court here are deliberating the guilt or innocence of the businessmen arrested in the first undercover sting operation designed to enforce a 1977 law against foreign bribery.

Enacted during the Watergate era, the Foreign Corrupt Practices Act had fallen into infrequent use. But enforcement has ballooned since the last years of the George W. Bush administration, as more companies do business abroad and senior corporate officials have had to certify financial statements under laws passed in response to corporate accounting scandals.

The four men on trial are among 22 businessmen charged in a sweeping investigation, most of them arrested last year as they were gathering for a trade show in Las Vegas where they anticipated picking up checks for their military hardware from Gabon's defense minister.

But no officials from the central African nation were really involved in the deal. Instead, it was brokered by undercover FBI agents and a cooperator from the industry who helped persuade his colleagues to sign onto the deal that would land them under indictment.

The sting produced the largest group of individuals ever charged for FCPA-related violations and is part of an increase in prosecutions that began in the Bush administration and has grown under the Obama administration. In 2004-05, the Justice Department charged seven people under the law and collected more than $27 million in criminal fines. In 2009 and 2010, the department charged more than 50 people and collected nearly $2 billion.

Although Securities and Exchange Commission investigations in the mid-1970s led to the law, Justice officials say bribery is still an issue today and have about 15 lawyers committed to prosecuting violations. They cite World Bank estimates that more than $1 trillion in bribes are paid each year, or roughly 3 percent of the world economy.

"When U.S. businesspersons, foreign executives and even foreign officials know that they risk liability under the FCPA and related statutes, behavior changes," Assistant Attorney General Lanny Breuer said in a speech last month to the World Bank. "In addition to motivating U.S. and foreign corporations to change the way they do business ? something that I believe is already happening ? the threat of liability can help corporations resist corrupt demands from foreign officials, which can lead the officials themselves to alter their practices."

The department's recent prosecutions have covered bribery across the globe, including Latin America, Africa and the Middle East, and the defendants have included corporations as well-known as Daimler AG, BAE, Siemens and Johnson and Johnson. The Houston-based firm Kellogg Brown & Root pleaded guilty to a decade-long scheme to bribe a range of Nigerian officials to get contracts worth more than $6 billion to build liquefied natural gas facilities.

In May, the department got the first-ever jury conviction against a corporation in an FCPA case ? previous corporate prosecutions had ended in agreements to plead guilty. Azusa, Calif.-based electrical utility supplier Lindsey Manufacturing, two of its executives and a broker were convicted of scheming to bribe officials at Mexico's state-owned utility company. Prosecutors said the bribes included a Ferrari Spyder sports car worth nearly $300,000, a $1.8 million yacht and payments of more than $170,000 toward one official's credit card bills.

In the case before the Washington jury, the FBI's first use of an undercover sting to enforce the act has become the heart of the defense case. Defense attorneys have been critical of the FBI's reliance on the informant, Richard Bistrong, an executive of a Florida body armor company with a checkered past. Prosecutors acknowledged he was a criminal and a "scoundrel."

Defense attorneys have labeled Bistrong a sociopathic liar with a devious mind and a history of bribery, embezzlement, tax evasion, drug use and solicitation of prostitutes. They say he was able to persuade federal agents to let him plead guilty to a single bribery count for more than $4.4 million in bribes to officials at the United Nations and overseas.

Bistrong lured the defendants to a Florida hotel room in May 2009 to meet a broker and offer them a chance to be part of a $15 million deal to outfit Gabon's presidential guard from head to toe in new gear. The catch was that they would have to prepare two invoices ? one written out to the broker for the real value of the deal and the other written out to the Gabonese government with a 20 percent commission added for the broker and the defense minister. The black-and-white hidden camera footage shown in court recorded Bistrong repeatedly stressing that half the 20 percent commission ? or $1.5 million ? would go to the defense minister.

But defense attorneys say he never used words like "bribe" or "kickback" to make clear the payment was illegal. Their clients each could face sentences of up to 10 to 15 years if convicted.

"They used a gotcha technique," defense lawyer Matthew Menchel told jurors in closing arguments. "It's not enough to use innocent sounding words and say, `Hey, everybody should know this is against the law.'"

Prosecutor Laura Perkins said the investigators relied on Bistrong to help build their case because people won't openly discuss such corrupt deals with outsiders they don't know. She said the defendants clearly knew that sending $1.5 million in public money to line a defense minister's pocket was wrong.

"The word is not what makes it wrong," she told jurors. "It is the payment itself regardless of what you call it."

The defendants and the positions they held during the sting are:

_Briton Pankesh Patel of Quartermaster's Ltd., a company based in the United Kingdom that sells military and law enforcement uniforms.

_John Benson Wier III of St. Petersburg, Fla., president of SRT Supply Inc., which sells tactical and ballistic equipment.

_Andrew Bigelow of University Park, Fla., managing partner and director of government programs for Heavy Metal Armory, which sells machine guns, grenade launchers and other firearms.

_Lee Tolleson of Mountain Home, Ark., director of acquisitions and logistics for ALS Technologies, a company that sells law-enforcement and military equipment.

U.S. District Judge Richard Leon has divided the defendants in the sting case into four groups for trial, with the other three groups yet to face a jury. Four other defendants have pleaded guilty.

Cholera kills 10 in central Nigeria: official (AFP)

MAIDUGURI, Nigeria (AFP) ? A cholera outbreak has killed 10 people in central Nigeria's Plateau State over the past two weeks, a local health official said Wednesday.

"We have recorded 10 deaths from the over 300 people infected with cholera in the last two weeks," Jacob Wangem, the official in the state health ministry, told AFP.

He said the areas worst hit by the disease were the state capital Jos and Barkin-Ladi municipality.

About 1,555 people died of cholera in Nigeria last year, according to the UN Children's Fund.

Water and food contamination as well as poor sanitation were the likely causes of the outbreak, he said.

Cholera is caused by a bacteria and transmitted through water or food that has typically been contaminated by human fecal matter.

"I can confirm he was excluded and that he managed to enter the UK. He has now been detained and the UK Border Agency is now making arrangements to remove him.

"A full investigation is now taking place into how he was able to enter."

ASEE Student Constituent Committee ? Business, networking, and dinner

Today was a busy day for the newly minted student division. We had our first business meeting, elections, networking event with the NEE, and annual dinner.

Business and elections
We had our first business meeting of the conference over lunch. We discussed our progress and growth over the past year, and took nominations for the new officer positions. If you haven?t done so already, be sure to cast your vote (ballot) by 11:30 am PST (3:30 EST) on June 28.

SD/NEE networking event
The networking event was amazing as we had a chance to connect with faculty and other students over drinks at the Elephant and Castle Pub. It was great to catch up with old friends and meet new people and play ?6 degrees of Kevin Bacon? as we tried to figure out if we knew any of the same people. As always, it was also great to hear how new faculty made the transition from students to teachers.

Annual dinner

Finally, the highlight of the evening was our annual dinner. The event was attended by 92 students ? way more than we could possibly have expected. The food was delicious, the conversations were fun, our sponsors were great.

If you ever have the chance to sit down with our industry sponsors over dinner, it can be a great experience. They have such a different perspective and they are so excited about developing the next generation of engineers. It?s amazingly encouraging to hang out with them.

Spectacular new species discovered in New Guinea (AFP)

MANILA (AFP) ? A frog with fangs, a blind snake and a round-headed dolphin are among more than 1,000 new species recently found on the incredible Melanesian island of New Guinea, environment group WWF said.

Scientists made the astounding discoveries, which also included a river shark and dozens of butterflies, on New Guinea at a rate of two a week from 1998 to 2008, WWF said in a new report on the island's natural habitat.

"This report shows that New Guinea's forests and rivers are among the richest and most biodiverse in the world," said WWF's Western Melanesia programme representative, Neil Stronach.

New Guinea -- divided between the Indonesian province of Papua in the west and Papua New Guinea to the east -- has one of the world's least spoilt and most stunning ecosystems.

Its rainforests are the third biggest in the world after the Amazon and the Congo, and, while the island covers just 0.5 per cent of the Earth's landmass, it contains up to eight percent of the world's species, according to WWF.

What was previously known about New Guinea's biodiversity was already breathtaking, such as the world's biggest butterfly -- with a 30-centimetre (12-inch) wingspan -- and giant rats that can grow up to a metre long.

Scientists believe that one square kilometre (247 acres) of the island's lowland rainforest may contain as many as 150 bird species, according to WWF.

The 1,060 species confirmed by scientists as new discoveries between 1998 and 2008 are believed to have only scratched the surface of New Guinea's dazzling ecosystems.

"Such is the extent of New Guinea's biodiversity that new discoveries are commonplace even today," WWF said in its report, titled "Final Frontier: Newly Discovered Species of New Guinea".

One of the most notable finds documented in the WWF report was a round-headed and snub-finned dolphin, which swims in protected, shallow coastal waters near rivers and creek mouths.

Discovered in 2005 in Papua New Guinea, it was the first new dolphin species recorded anywhere in the world in three decades, and is now known to also exist in Australia, WWF said.

Another of the 12 mammals found over the decade was an anteater named in honour of British naturalist Sir David Attenborough, Sir David's Long-beaked Echinda or, scientifically, Zaglossus attenboroughi.

One of the 134 frogs discovered was dubbed Litoria sauroni because its striking red and black spotted eyes reminded scientists of the evil character Sauron in the "Lord of the Rings" movies.

Another new frog was notable because of its tiny size -- just one centimetre in length, while one had vampire-like fangs.

Nine snail species, some so colourful as to be almost unrecognisable from the backyard-garden-type variety, were among the 580 new invertebrates discovered.

One of the snails was bright yellow, while another was green and yellow.

Among the other new invertebrates was a brightly coloured apricot crayfish, part of the family of creatures called "yabbies" in Australia and some other parts of the world, which was nine to 12 centimetres long

New fish totalled 71, with a kaleidoscope of colours, including one in the coral reefs of Milne Bay in Papua New Guinea that thrilled scientists with its dazzling blue hue.

WWF said the most extraordinary freshwater discovery was a 2.5-metre-long river shark found in Papua New Guinea that has since also been located in northern Australia.

Of the 43 reptiles discovered, one could claim to be the most innocuous snake in the world -- it was just 12-14 centimetres long, had scales over its eyes so that it could not see, could not bite and had no venom.

But WWF said the excitement of all the new discoveries had been tempered by the fact that, like in the Amazon and Borneo rainforests, human actions were destroying New Guinea's natural habitat at an "alarming rate".

Some of the growing threats it listed were illegal and unsustainable logging, forest conversion for palm oil plantations, mining, road construction and unsustainable fishing.

"These environmental threats are exacerbated by global climate change which is increasing the number of fires within forests and savannas, erosion, and seawater incursion into coastal habitats," WWF said.

Food watchdog advises against raw sprouted seeds (AFP)

LONDON (AFP) ? Britain's Food Standards Agency has recommended that sprouted seeds be cooked thoroughly before consumption, and advised against eating them raw, following an outbreak of E.coli poisoning in France.

"Following further cases of E. coli in France, the FSA is revising its guidance on the consumption of sprouted seeds such as alfalfa, mung beans -- usually known as beansprouts -- and fenugreek," said an updated statement issued over the weekend.

"As a precaution, the Agency is advising that sprouted seeds should only be eaten if they have been cooked thoroughly until steaming hot throughout; they should not be eaten raw," it added on Saturday.

A British mail order plant and seed company has meanwhile distanced itself from claims that its products might have been behind the French outbreak.

Thompson & Morgan, which is based in Ipswich in eastern England, is co-operating with the investigation into the matter.

Frederic Lefebvre, French secretary of state for consumer affairs, on Friday linked seed sprouts sold by the company to 10 suspected cases of E.coli poisoning around the region of Bordeaux, southwestern France.

The FSA has already stressed that no cases of such food poisoning have yet occurred in Britain.

"The investigations into the outbreak of E. coli in France have suggested a possible link to sprouting seeds from a company based in the UK," the FSA said on Saturday.

"To date, no cases of food poisoning have been reported in the UK linked to the outbreak in France.

"We are in close contact with the Health Protection Agency who is actively monitoring the situation."

And it added: "The Agency also advises that equipment which has been used for sprouting seeds should be cleaned thoroughly after use. You should always wash your hands after handling seeds intended for planting or sprouting."

(Thursday, June 23, 2011) ? Investigators with the Rochester Office of Public Integrity and the Rochester Police Department have arrested the owner of a business performing work for the City on charges related to insurance fraud.

Christine Clendenning, 42, of 320 Lakeshore Blvd. Extension was arrested Wednesday morning and charged with Falsifying Business Records in the First Degree (E-Felony), Grand Larceny in the Third Degree (D-Felony), Fraudulent Practices (E Felony) and Workers? Compensation Fraud (E Felony).

Clendenning is the owner of Christine Custom Design Inc. and had a contract to perform home rehabilitation work for the City in partnership with the Group 14621 Community Association and the South Wedge Planning Committee between Nov. 20, 2007 and July 2, 2010. The contract required that Clendenning have workers compensation insurance.

An auditor with the New York State Insurance Fund discovered that Clendenning did not have workers compensation insurance but provided false certificates claiming to have it. Those findings were reported to the Office of Public Integrity.

?This arrest, like others before it, demonstrates that we hold our contractors to the same ethical and legal standards as our employees,? said Office of Public Integrity Director David Moore. ?These contracts are awarded on a competitive basis, so we cannot tolerate those who would lie or scheme to gain an advantage in this marketplace.?

The investigation was conducted with cooperation from State of New York Workers? Compensation Board Office of the Fraud Inspector General; New York State Insurance Fraud Bureau; New York State Insurance Fund and the Monroe County District Attorney?s Office.

Clendenning was arraigned in Rochester City Court today and released on her own recognizance.
